Mignonette Bridal - Terms & Conditions

Please read these Terms and Conditions carefully as they will form a legally binding contract between Mignonette Bridal and you, the Customer. By entering into an agreement with Mignonette Bridal

you agree to comply with and be bound by the following Terms and Conditions. These Terms and Conditions are governed by English law under UK jurisdiction.


Definitions and interpretation - In these Terms and Conditions, the following definitions are used:

Mignonette Bridal, our, we or us – Mignonette Bridal, a company incorporated in England and Wales with registered number 05945182. Our registered address is The Chapel 38a Church Road, Slip End, Luton, Beds, LU1 4BJ. Our VAT number is 386 564 941

You or Your – the customer or person who enters into this agreement and places an order with Mignonette Bridal

Customer – you or the person who enters into this agreement and places an order with Mignonette Bridal

Writing or written – when used in these Terms and Conditions will include emails

Goods – when used in these Terms and Conditions will refer to all items (to include bridal, bridesmaids and prom gowns, accessories to include earrings, tiara’s, veils, basques, shoes, undershirts) chosen

and ordered through Mignonette Bridal


Accepting your Order

It will be deemed that we have accepted your order once you have paid a non-refundable deposit of 50% of the total cost (including VAT) of the goods you wish to order, and a legally binding contract will come into existence between you and us.

Once the goods are ordered you have no rights if you simply change your mind (Sale of Goods Act 1979). All items are non-returnable.

Deposits are non-refundable. The deposit cannot be transferred to another person or goods. This does not affect your statutory rights.

This contract is between you and us. No other person or persons shall have any rights under this contract to enforce any of its terms. We may transfer our rights and obligations under these terms to another organisation. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.

If we discover that the goods ordered are not available due to discontinuation, unavailability, or any other reason that would make it impossible for us to fulfil your order, then you will be entitled to your money back, we will not be held liable for breach of contract, or compensation. 


Cancellation

After your order has been accepted by us and a deposit has been paid, we do not accept cancellations of your order for whatever reason and any monies already paid will not be refunded.  Failure to pay for your goods in full will be considered a breach of this contract and we reserve our rights in this respect.

Please make sure any goods purchased are suitable for your requirements as we will be unable to refund or replace said goods that are returned as unsuitable or do not fit. Any items cancelled after an order has been placed with us will be subject to the full amount being immediately payable. We strongly recommend insurance is taken out for such unforeseen circumstances.

Any Sale or Sample items bought from us cannot be returned or any monies refunded; these are ‘Sold as Seen’. 

For reasons of hygiene ALL ACCESSORIES - namely tiaras, hair slides, earrings, veils, basques and shoes - which have been removed from the premises, once paid for, cannot be refunded or exchanged. 

Shoes ordered for sizing must be tried on in store so they can be exchanged in the condition received and within the time period set by the supplier if another size/style is required.  


Our rights to end the contract

We may end the contract for a product at any time by writing to you if:

(i) you do not make any payment to us when it is due;

(ii) you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the product/s;

(iii) you do not, within a reasonable time, allow us to deliver the products to you (if applicable) or collect them from us.

If we end the contract under any of the points (i) to (iii) set out above, we will not refund any payments you have paid for the product/s. You will still be responsible for any outstanding balance on the order (including any storage costs and loss of profit).


Payment

All items remain the property of Mignonette Bridal until payment is received in full. 

We only accept payment by debit or credit card or by prior arrangement bank transfer.

We will ask you to inspect your item or items within 21 days of arrival in the store. At this point the settlement of all outstanding balances is due.


Description of Goods

Products may vary slightly from their pictures. The images of the products in any promotional materials or on the Website are for illustrative purposes only. Although we have made every effort to display the colours accurately online, we cannot guarantee that a device’s display of the colours or the printed images in our brochure accurately reflects the colour of the product/s. 

Whilst we can occasionally arrange for a fabric swatch to be supplied, we cannot guarantee that they will exactly match or accurately reflect your dress for colour or fabric, they are intended as a guide.  Products may therefore vary from images or samples. Please note that colours can appear different depending on the lighting conditions. 

Mignonette Bridal employees or consultants provide guidance in the choice of design, size, colour, and measurements without any liability. All garments, unless stated otherwise, are ceremonial and are to be used for ceremonial purposes only. We will not be held liable for claims for loss or damage to garments that may occur after the marriage ceremony. Any claims for loss or damage will be forensically  investigated at our expense.


Providing the goods

During the order process, we will let you know an estimated time frame of when we will provide the goods to you. Please be aware unless a fixed date for delivery has been agreed in writing, we will  provide you with an estimated delivery date, considering the complexities of any potential alterations required, and the location the product is being sourced from. 

We will make every attempt to work within this delivery date and will keep you notified of any delays. By way of guidance only, products that are not in stock typically can take up to 6 months to arrive and can take longer during peak periods. If an order is placed late, the item may not arrive until a few days before the wedding. 

We are not responsible for delays outside our control. If our delivery of the product/s is delayed by an event outside our control, then we will contact you as soon as possible to let you know and we will take  steps to minimise the effect of the delay. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay in that we cannot fulfil the contract by the date of  your wedding, you may contact us to end the contract and receive a refund for any products you have paid for but not received. 


Measurements

Once measurements and sizing have been taken for your order, we will not be held responsible for any weight loss or gain or any other changes in your measurements and sizing (for example due to pregnancy, weight gain or loss). If your measurements and sizing change it will be your responsibility to notify us, in which case we will confirm if we are able to make further alterations prior to delivery and what the estimated additional costs will be. 

We will measure each person for each order and advise on the size to be ordered. If you are not happy with the sizing, you must inform us at the time of order. We will not be responsible for any sizing  discrepancies after this time.

If a customer defers being measured to a later date, it will be the customer’s responsibility to ensure that such measurements are taken in good time for the goods to be ordered and delivered in time.


Fittings & Alterations

Mignonette Bridal cannot provide an exact delivery date for items, but customers can expect their first fitting to be carried out approximately 12-14 weeks before the wedding, unless the sales order is for a ‘SHORT ORDER’ or late order, in which case first fittings may be carried out during the week of the wedding and possibly even the day before. 

Customers are asked to settle any balance due by the date of the goods arriving in store before alterations are carried out – a letter or phone call will be sent to inform the customer of the goods arrival in  store.

All outstanding balances MUST be settled BEFORE the date of the first fitting. 

No fittings will be carried out on gowns that are not fully paid for by the date required.

Customers are asked to make themselves available for all fittings and alterations when reasonably required and should be prepared to attend at least three fittings.  It is essential that the customer brings their chosen wedding underwear and footwear to their fitting appointments. We will not be responsible for any issue relating to unsuitable underwear being worn which may affect the structure of the  dress, or shoes that may damage or affect the length of the dress. 

The price of any goods excludes all costs in respect of any alterations or fitting work howsoever this service is provided.  Mignonette Bridal offers a fitting and alterations service by a fully experienced and competent alterations specialist. Customers are not obliged to use the alteration services provided by Mignonette Bridal, but if you do not require our alterations service you must inform us immediately. Mignonette Bridal will not be held responsible for alterations carried out by a third party.  

It is not policy to take in any gown by any more than one dress size (maximum 2) as this could adversely affect the style and look of the garment. Advice taken from the alteration specialist is also taken at  the customers own risk and personal choice, the specialist cannot be held responsible for any decisions made about the alteration of any garment which are deemed unsatisfactory after any  alterations are completed, if the customer requested them. Any goods purchased from another retailer will not be altered by our alteration’s specialist. 

Mignonette Bridal can steam goods purchased from another retailer at the customer’s request; this will be at the customers risk, and a fee of £65.00 (including VAT) will be payable in advance.


Storage

We will insure and store your goods up to 24 hours before the customer’s original event date as advised on the order form at a cost of £35. After this date a charge of £1 per calendar day will apply. 

For dry cleaning we will provide free storage for 21 days of notification to you that it is ready for collection, after which a £1 per calendar day storage fee will apply. 

If there is an accumulation of 3 or more months unpaid storage fees, then we will class the goods as abandoned. 


Non-collection of goods

If you do not collect or arrange collection of your goods within 6 months of the original event date as advised by you to us, or on the order form or to us in another way, then the contract will be deemed  cancelled without any further notification and any monies paid will not be refunded and you will automatically lose ownership. 


Our responsibility for loss or damage suffered by you

In the unlikely event that customers paid for goods are lost or damaged, due to fire, flood, or theft, whilst on our premises we shall only be responsible for reimbursing the retail costs of such goods. Should the store breach its obligations under this agreement, its liability is limited to any direct loss incurred by the customer arising from such breach. 

The store will NOT be liable for any breaches caused by circumstances outside Mignonette Bridal’s control, including but not restricted to acts of God, war, riot, terrorism, malicious damage, fire, flood, or storm. 

We shall not be responsible for any services provided by a third party, whether or not such third party was recommended by us.

We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business,  business interruption, or loss of business opportunity.


Complaints or Faults

We hope your goods are as expected and without fault. If you discover a fault with your goods, you must report the fault as soon as the fault is noticed. We will endeavour to rectify the fault to the best of our ability as soon as possible and in accordance with your legal rights.
